1. Introduction & Acceptance

The domain name (website) www.astoundingbi.com is owned and managed by Astoun Ding Bi (Pvt) Ltd, registered as a Private Limited Liability Company under the laws of the Democratic Socialist Republic of Sri Lanka (hereinafter referred to as "AstoundingBI"). All references to "AstoundingBI," "we," "us," or "our" in these Terms and Conditions refer to Astoun Ding Bi (Pvt) Ltd.

By accessing, browsing, or using the website located at www.astoundingbi.com ("the Website"), registering an account, purchasing any product or service, or otherwise engaging with our platform, you ("User," "you," or "your") unconditionally agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, Delivery Policy, and Returns & Refunds Policy, and any other policies referenced herein.

Legal Validity of Electronic Agreement: These Terms constitute a legally binding electronic contract between you and AstoundingBI. In accordance with the Electronic Transactions Act, No. 19 of 2006, a contract formed in electronic form shall not be denied legal validity or enforceability solely on the ground that it is in electronic form. Your acceptance by clicking, checking a box, or continuing to use the Website constitutes a valid electronic acceptance under Sri Lankan law. If you do not agree to any part of these Terms, you must immediately cease using the Website and its services.

2. Definitions

  • "Computer Crime Act" refers to the Computer Crime Act, No. 24 of 2007 of Sri Lanka.
  • "Content" refers to all text, images, videos, tutorials, software, data, and other material available on the Website.
  • "Digital Products" refers to software, downloadable files, and other electronic products sold on the Website.
  • "Electronic Record" means information, data, or communications generated, stored, received, or sent in electronic form, as defined under the Electronic Transactions Act, No. 19 of 2006.
  • "Event Tickets" refers to tickets for events sold or facilitated through the Website, including but not limited to Kandy Esala Perahera 2026.
  • "Information System" means an electronic system for creating, generating, sending, receiving, storing, reproducing, displaying, recording, or processing information.
  • "Intellectual Property" refers to all trademarks, copyrights, patents, trade secrets, industrial designs, and any other proprietary rights owned by or licensed to AstoundingBI, protected under the Intellectual Property Act, No. 36 of 2003.
  • "Payment Device" means any credit card, debit card, or electronic payment instrument as defined under the Payment Devices Frauds Act, No. 30 of 2006.
  • "Services" refers to all products, digital goods, tutorials, blog content, and event ticketing offered by AstoundingBI.
  • "User Account" refers to the registered profile created by a user to access services on the Website.

3. Eligibility

You must be at least 18 years of age to use this Website and make purchases. If you are between 13 and 17 years of age, you may use the Website only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

By using this Website, you represent and warrant that you are legally capable of entering into a binding contract under the laws of Sri Lanka, including the provisions of the Electronic Transactions Act, No. 19 of 2006, and that all information you provide is truthful and accurate.

If you are using the Website on behalf of a company, business, or other organization, you represent and warrant that you have authority to bind that entity to these Terms. AstoundingBI reserves the right to refuse service, terminate accounts, or cancel orders at its sole discretion for any user who does not meet these eligibility requirements.


4. User Accounts & Registration

4.1 Account Creation

You may be required to create an account to access certain features or make purchases on the Website. You must provide truthful, accurate, current, and complete information during registration and agree to promptly update your account information to keep it accurate and current.

4.2 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials, including your username and password. You are responsible for all activities that occur under your account, whether or not authorized by you.

Important: The unauthorized disclosure of login credentials or access information enabling access to a computer service constitutes a criminal offence under Section 10 of the Computer Crime Act, No. 24 of 2007, punishable by fines up to Rs. 300,000 and/or imprisonment up to three years.

You must immediately notify AstoundingBI of any unauthorized use of your account or any security breach. AstoundingBI will not be liable for any loss or damage arising from your failure to safeguard your credentials.

4.3 Account Suspension & Termination

AstoundingBI reserves the right to suspend, restrict, or permanently terminate your account at any time, with or without notice, if you violate these Terms or engage in fraudulent, abusive, or unlawful conduct. Upon termination, your right to use the Website and access any associated content ceases immediately. You may request deletion of your account by contacting us through the Contact Us page on the Website.


5. Products & Services

5.1 Software Products

AstoundingBI offers software products for individual and business use. Software and digital products are protected as literary, artistic and scientific works (specifically as computer programs) under Part II of the Intellectual Property Act, No. 36 of 2003.

You may not copy, modify, adapt, translate, reverse engineer, decompile, disassemble, resell, sublicense, or create derivative works from any software product purchased from AstoundingBI without prior written consent. Software licenses are granted per the number of users or devices specified at the time of purchase. Using a single-user license across multiple users or devices is a violation of these Terms and may constitute copyright infringement under Sri Lankan law.

Permitted archival copying: Consistent with Section 12(7) of the Intellectual Property Act, you may make a single archival backup copy of software you have lawfully purchased, solely for replacement use if the original is lost, destroyed, or rendered unusable. No such archival copy may be used for any other purpose.

5.2 Event Tickets

AstoundingBI facilitates the sale of event tickets, including tickets for the Kandy Esala Perahera 2026 and other events. All ticket sales are subject to availability, and AstoundingBI does not guarantee availability at the time of purchase.

Pre-orders are subject to confirmation and may be subject to change based on event organizer decisions; AstoundingBI will notify you via email if your pre-order cannot be fulfilled. Tickets are issued for the named purchaser and are non-transferable unless explicitly stated otherwise. AstoundingBI acts as a facilitator and is not responsible for changes to event schedules, venue, or cancellations by the event organizer. You are responsible for ensuring compliance with any entry requirements set by the event organizer.

5.3 Blog & Tutorial Content

AstoundingBI publishes blog articles, how-to guides, and tutorial videos for informational and educational purposes. All blog and tutorial content is provided "as is" and AstoundingBI makes no warranty that such content is error-free, complete, or up to date.

By following, replicating, or acting upon any content published on our blog or video channels, you do so entirely at your own risk. Content is intended for general informational purposes only and should not be relied upon as professional advice (legal, financial, technical, or otherwise).

5.4 Software License (Baseline)

Unless otherwise stated in a separate license agreement provided at purchase, shown at checkout, or included with the download, you receive a limited, revocable, non-exclusive, non-transferable license to use the purchased digital product or software for your own internal or personal use only. You may not resell, redistribute, sublicense, or publicly share any license keys, downloads, copies, or paid materials. Any use beyond this baseline license requires our prior written consent or an appropriate additional license.

Criminal Liability: Wilful infringement of software rights constitutes a criminal offence under Section 178(3) of the Intellectual Property Act, No. 36 of 2003, punishable by a fine not exceeding Rs. 500,000 and/or imprisonment for up to six months.

5.5 Updates and Support

We may, at our discretion, provide updates, patches, or new versions of our software or digital products from time to time. Unless expressly stated in the relevant product description or in a separate support or maintenance agreement, we are not obligated to provide updates, bug fixes, new features, or continued compatibility. Support services are provided only where explicitly included with the product or purchased under a separate support plan.


6. Ordering & Payments

6.1 Order Placement

By placing an order on the Website, you are making an offer to purchase a product or service, which AstoundingBI may accept or decline. A contract is formed only upon AstoundingBI's acceptance of your order, confirmed via an order confirmation email sent to your registered email address. Under the Electronic Transactions Act, No. 19 of 2006, an order confirmation sent by email constitutes a valid electronic communication and shall be deemed received when it enters your designated information system.

AstoundingBI reserves the right to cancel any order due to pricing errors, stock unavailability, suspected fraud, or any other reason, and will issue a full refund in such cases.

6.2 Pricing

Unless stated otherwise, prices may exclude taxes, duties, bank fees, and foreign exchange fees charged by your payment provider or required by law. AstoundingBI reserves the right to modify prices at any time without prior notice, though price changes will not affect already confirmed orders. In the event of a pricing error, AstoundingBI reserves the right to cancel the order and notify you, even after a confirmation email has been sent.

6.3 Product Information

We aim to describe our products and services as accurately as reasonably possible. However, we do not warrant that descriptions, pricing, images, or availability information are complete, reliable, or error-free. If an error is discovered, we reserve the right to correct it and to modify, cancel, or refuse orders based on incorrect information.

6.4 Payment Methods & Security

AstoundingBI accepts payments through the methods listed at checkout. All payment transactions are processed by secure, third-party payment processors and AstoundingBI does not store, collect, or have access to your full payment card details.

Payment Fraud Warning: Any use of unauthorized, counterfeit, stolen, or fraudulently obtained payment devices on this Website constitutes a serious criminal offence under the Payment Devices Frauds Act, No. 30 of 2006, carrying penalties of up to ten years' imprisonment and/or fines up to Rs. 500,000. This includes generating fraudulent account numbers, furnishing payment card details without holder authority, and making fraudulent merchant applications. AstoundingBI will report suspected payment fraud to law enforcement authorities.

You represent and warrant that you are fully authorized to use the selected payment method and that all information you submit is true, accurate, and complete. In the event of a chargeback or payment dispute, AstoundingBI reserves the right to suspend or restrict your account pending investigation.

6.5 Anti-Money Laundering Compliance

AstoundingBI is committed to compliance with the Financial Transactions Reporting Act, No. 6 of 2006. We reserve the right to conduct identity verification on users and to report any transactions that we reasonably suspect may be related to money laundering, terrorism financing, or any other unlawful activity to the relevant authorities, including the Financial Intelligence Unit, as required by Sri Lankan law. We may refuse to process or may freeze transactions where required to do so by law.


7. Intellectual Property

7.1 Ownership

All content published on the Website — including but not limited to software code, text, graphics, logos, icons, images, tutorial videos, blog articles, and data compilations — is the exclusive intellectual property of AstoundingBI or its licensors. Such works are protected under the Intellectual Property Act, No. 36 of 2003 of Sri Lanka and applicable international intellectual property laws, including copyright protection for literary, artistic, scientific works, and computer programs.

The economic rights of AstoundingBI in its works include the exclusive right to reproduction, distribution, adaptation, translation, public display, broadcasting, and other communication to the public, as provided under Section 9 of the Intellectual Property Act. These rights are protected for the life of the author plus 70 years, or 70 years from first publication for corporate works.

7.2 Limited License for Personal Use

AstoundingBI grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Website's content solely for personal, non-commercial purposes.

7.3 Restrictions

You may not, without prior written permission from AstoundingBI:

  • Reproduce, republish, distribute, or publicly display any content from the Website.
  • Use any content for commercial purposes.
  • Remove or alter any copyright, trademark, or proprietary notices.
  • Scrape, crawl, or use automated tools to extract data from the Website.
  • Circumvent any copy protection or digital rights management (DRM) measures — such conduct is treated as an infringement under Section 23 of the Intellectual Property Act, No. 36 of 2003.

7.4 Trademark Notice

AstoundingBI's name, logo, and all related marks are trademarks of Astoun Ding Bi (Pvt) Ltd, protected under the Intellectual Property Act, No. 36 of 2003. Unauthorized use of our trademarks is prohibited and may constitute a criminal offence under Section 184 of the Intellectual Property Act, punishable by fine up to Rs. 500,000 and/or imprisonment.

7.5 User-Submitted Content

If the Website allows you to submit content (including comments, reviews, or messages), you retain ownership of your content. However, by submitting content, you grant AstoundingBI a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display that content as necessary to operate, improve, and promote the Website and our services.

You represent and warrant that you have all rights necessary to submit the content and that your content does not violate any applicable law, including the Intellectual Property Act, No. 36 of 2003, or infringe any third-party rights. AstoundingBI reserves the right to monitor, review, and remove any content at its sole discretion, including where we reasonably believe it is abusive, defamatory, infringing, illegal, misleading, or spam.


8. Prohibited Conduct

When using the Website, you must not:

  • Violate any applicable local, national, or international laws or regulations.
  • Use the Website to engage in fraudulent, deceptive, or misleading activities.
  • Attempt to gain unauthorized access to the Website, its servers, databases, or associated systems — this constitutes an offence under Sections 3 and 4 of the Computer Crime Act, No. 24 of 2007, punishable by up to five years' imprisonment and/or fines up to Rs. 200,000.
  • Introduce viruses, malware, trojans, or any harmful code that causes unauthorized modification or damage to any computer or computer system — this constitutes an offence under Section 5 of the Computer Crime Act, punishable by fines up to Rs. 300,000 and/or imprisonment up to five years.
  • Illegally intercept any communications, subscriber information, or traffic data to, from, or within our systems — this constitutes an offence under Section 8 of the Computer Crime Act.
  • Buy, receive, sell, or deal with data you know to have been unlawfully obtained from any computer or information system, in violation of Section 7 of the Computer Crime Act.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Engage in data mining, scraping, or unauthorized data collection from the Website.
  • Post or transmit unsolicited commercial messages (spam).
  • Harass, abuse, threaten, or intimidate other users or AstoundingBI staff.
  • Resell, redistribute, or sublicense any purchased product without written authorization.
  • Use or attempt to use any counterfeit, stolen, or unauthorized payment device — a serious offence under the Payment Devices Frauds Act, No. 30 of 2006.
  • Open an account or conduct transactions using a false, fictitious, or fraudulent identity — an offence under the Financial Transactions Reporting Act, No. 6 of 2006.
  • Transmit indecent, obscene, seditious, scurrilous, threatening, or grossly offensive content, in violation of Section 58 of the Sri Lanka Telecommunications Act (Consolidated 2024).
  • Wilfully intercept or seek to intercept any electronic communication not intended for you, contrary to Section 53 of the Telecommunications Act.

Violation of these prohibitions may result in immediate account termination, civil claims, and/or referral to law enforcement authorities, including exposure to criminal liability under the applicable Acts referenced above.


9. Data, Privacy & Electronic Communications

AstoundingBI collects and processes personal data in connection with your use of the Website. Data messages, electronic records, and electronic documents exchanged between you and AstoundingBI have full legal recognition and validity under the Electronic Transactions Act, No. 19 of 2006.

Electronic records retained by AstoundingBI in connection with your orders and transactions shall be maintained in a reliable manner and shall be capable of subsequent reference, in accordance with the data retention principles of applicable Sri Lankan law. AstoundingBI will not disclose your personal data to third parties except as required by law, including disclosures to the Financial Intelligence Unit or law enforcement as required under the Financial Transactions Reporting Act, No. 6 of 2006.

You agree to indemnify, defend, and hold harmless AstoundingBI, its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Website; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any content you submit to the Website; or (e) your commission of any offence under the Computer Crime Act, Payment Devices Frauds Act, Intellectual Property Act, Financial Transactions Reporting Act, Electronic Transactions Act, or any other applicable Sri Lankan law.

16. Force Majeure

17. Governing Law & Dispute Resolution

17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka, without regard to conflict of law principles.

17.2 Dispute Resolution

In the event of any dispute arising from or related to these Terms, both parties agree to first attempt resolution through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to mediation or arbitration in Colombo, Sri Lanka, in accordance with applicable Sri Lankan law. You agree that any legal action must be brought exclusively in the courts located in Colombo, Sri Lanka.


18. Electronic Notices

In accordance with the Electronic Transactions Act, No. 19 of 2006, all notices, communications, and agreements between AstoundingBI and you may be made electronically. Electronic communications shall be deemed received at the time they enter your designated information system. It is your responsibility to ensure that the email address registered with your account is accurate and current.


19. Reporting Offences & Cooperation with Authorities

AstoundingBI will cooperate fully with law enforcement authorities in relation to any investigation of offences under the Computer Crime Act, No. 24 of 2007, the Payment Devices Frauds Act, No. 30 of 2006, the Financial Transactions Reporting Act, No. 6 of 2006, the Intellectual Property Act, No. 36 of 2003, or any other applicable Sri Lankan law. Where required by law, AstoundingBI will preserve electronic records and disclose information to the Financial Intelligence Unit, police, or other relevant authorities.

AstoundingBI may, in its discretion, report suspicious activity on user accounts to the relevant authorities without prior notice to you, where required or permitted by law.


20. Changes to Terms

AstoundingBI reserves the right to modify, update, or replace these Terms at any time at its sole discretion. Changes will be posted on this page with an updated "Last Updated" date. For material changes, AstoundingBI may notify registered users by email. Your continued use of the Website after changes are posted constitutes your acceptance of the revised Terms. If there is any conflict between these Terms and any product-specific or event-specific terms, the relevant product-specific or event-specific terms will control for that product or event.


23. Entire Agreement

These Terms, together with our Privacy Policy, Delivery Policy, Returns & Refunds Policy, and any other policies or agreements referenced herein, constitute the entire agreement between you and AstoundingBI with respect to your use of the Website and supersede all prior agreements, representations, and understandings.
